August 1, 2019:
A client who was previously convicted for Manufacture, Delivery, or Possession with Intent to Manufacture or Deliver (Title 35 Pa.C.S. Section 780-113 Subsection A30) had his probation detainers lifted today after the criminal defense team at Kenny, Burns & McGill was hired to handle the case.
The client picked up a new case for Possession with Intent, with allegations that the client was selling crack cocaine, heroin, suboxone, and Xanax. A probation detainer was lodged and the client was arrested and held in jail pending the final disposition of his open matter.
In addition, the client had previously been found guilty for possession of a controlled substance under Title 35 Pa.C.S. Section 780-113 Subsection A16.
The client and his family reached out to Criminal Defense Lawyer Thomas D. Kenny, of Kenny, Burns & McGill to help him. Attorney Kenny went to the Justice Juanita Kidd Stout Center for Criminal Justice located at 1301 Filbert Street to argue the probation detainer in court.
The Court, after hearing arguments from both sides on a motion to lift the probation detainer, ruled in our client’s favor and lifted the detainer. The client will be released on electronic monitoring/VEM Program over Commonwealth objection. In addition, client will be allowed to leave house arrest to work and provide for his family. Further, the Court lifted the second detainer and terminated the case, a very successful result.
July 29, 2019:
A client applied for a job and during the interview process, it became clear that there was a warrant for his arrest. Upon further investigation, our client learned that they had a warrant for not appearing in court on charges of possession of a controlled substance, Title 35 Pa.C.S. Section 780-113 A16.
