No Jail Time for New Jersey Client Caught Transporting Gun

There is little room for error when it comes to gun laws in our country. Recently, a Pennsylvania mom found this out the hard way when a simple mistake while carrying her gun wound up with her arrest and imprisonment. This working mother, who we will call Marisol Rivera, was employed at a Drug Rehabilitation Facility in Pennsylvania, and she obtained a Pennsylvania license to carry a firearm for her protection.

Unaware of the specific laws outside of the state, Ms. Rivera took her children for a pleasant family ride down the Jersey shore, where she was pulled over for the minor traffic violation of failing to signal a turn. As had been recommended to her when encountering law enforcement, Ms. Rivera advised the officer that she was a “lawful” carrier of a firearm. Unfortunately, Ms. Rivera’s license only made her a valid carrier in Pennsylvania, so she was arrested for gun violations in New Jersey.

Luckily, Ms. Rivera then hired Eileen T. Burns, New Jersey Criminal Lawyer, to help in her defense. Defense Attorney Burns immediately went to the aid of Ms. Rivera, and Attorney Burns was able to arrange for Ms. Rivera to be released from jail.

Criminal Lawyer Burns quickly got to work and, after a large amount of legal research and negotiation with the prosecutor assigned to the case, helped Ms. Rivera to qualify for a special New Jersey diversion program known as a Pre-Trial Intervention, or PTI.

After arguing the case for her client’s eligibility, Defense Attorney Burns successfully gained approval for Ms. Rivera to enter the PTI program. Once Ms. Rivera completes the program, she will have no criminal record from this incident – a great victory for a mom who made a simple mistake.

Federal licenses to carry a firearm are almost impossible for ordinary citizens to obtain, and the laws around guns and moving them between states are complex and intricate.
