RICO Charges Tossed Out

The criminal defense team at Kenny, Burns & McGill are proud to announce that all of a client’s unsubstantiated RICO charges have been dropped!

“RICO” refers to the RICO Act and stands for “Racketeer Influenced and Corrupt Organizations.” The RICO Act is a federal law that targets organized crime by making it illegal for people to belong to any business or enterprise with a pattern of racketeering. This Act also criminalizes employers asking their workers to commit crimes for them.

When our client came to us, he was in a tough spot; the county Attorney General was prosecuting him on more than a dozen charges, several of which were RICO charges. Given that RICO is an organized crime statute, even a single RICO charge carries the possibility of years in prison and/or hundreds of thousands of dollars in fines.

Looking at some very serious trouble, our client made the smart choice to hire a law office with decades of experience dealing with RICO and other charges.

Criminal Defense Attorney Thomas D. Kenny went to work for his client as soon as he was hired. Having dealt with many cases like this, RICO Lawyer Kenny knew the first steps were to diligently review the alleged evidence and to conduct a thorough investigation.

Through this work, Criminal Defense Lawyer Kenny found that most of the evidence against his client was not particularly convincing. Attorney Kenny put together a powerful defense of his client and went in front of the judge to present his findings.

Wonderfully, RICO Attorney Kenny was able to negotiate a disposition which did not include any of the original RICO charges! Our client went from looking at the possibility of decades in prison to only two years of probation — no jail time at all.

This success story is not only a great outcome for our client, whose life was not upended over charges that could not be proven, but for the community as well. Lengthy prison sentences for people who do not deserve them doesn’t help any of us.

If you or a loved one have had RICO charges brought against you, or believe you are under investigation, act quickly — it is important that you hire a knowledgeable attorney as early in the process as possible.
