Criminal Law update: DUI, gun charges dismissed

Philadelphia results:

Client was facing charges of Firearms not to be carried without a license, a felony of the third degree; carrying a firearm in a public place in Philadelphia, a misdemeanor of the first degree among other charges. Client hired Criminal Defense Lawyer Thomas D. Kenny of Kenny, Burns & McGill to defend him. Client was arrested on multiple counts of new charges including Aggravated Indecent Assault, a felony of the first degree, and Indecent Assault, a misdemeanor of the second degree, among others. Bail was set for ten thousand dollars cash. Said charges were an apparent violation of client’s probation supervision for DUI charges. Client’s probation officer lodged a detainer after client’s family tried to post bail. At Juanita Kidd Stout Center for Criminal Justice located at 1301 Filbert Street, Philadelphia, PA Criminal Defense lawyer Thomas D. Kenny of KBM was able to successfully argue that the supervision for DUI was subsequent to the charges lodged against the client and the detainer was lifted and client was allowed to post bail and get released so he could go back to work.

Client was arrested on assault charges. Client’s family hired Thomas D. Client was facing multiple charges of DUI including, Title 75 Section 3802 Sections D2, DUI with a controlled substance; Title 75 Section 3802 Sections D1i, DUI with a schedule 1 Controlled substance; and Section 3802 Sections D1iii, DUI with a Metabolite. Client hired Thomas D. Kenny of Kenny, Burns & McGill to plead his case. At Magistrate court 38-1-05 located at 117 York Road, Jenkintown, PA, Attorney Kenny was able to get the charges dismissed.

Bucks County results:

Client was facing charges including criminal attempt of possession of a firearm as a convicted felon and materially false written statement in purchase delivery or transfer of a firearm. Delaware County Results:

Finally, a word from the Pennsylvania Supreme Court. In a very recent decision below, the Pennsylvania Supreme Court suppressed a warrantless search of a citizen who was carrying a firearm and was not committing any other criminal violation since it is legal for citizens to carry firearms in the Commonwealth of Pennsylvania.
