House Arrest Secured for Client Caught With Cocaine

After long negotiations with the Office of the District Attorney, one of Kenny, Burns & McGill’s clients was released to house arrest today, despite having been arrested with more than thirty grams of cocaine and more than two thousand dollars cash.

The defendant was initially charged with the following three drug offenses, two of which are felonies:

  • Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver (a felony) — 35 § 780-113 §§ A30
  • Possession of a Controlled Substance (a misdemeanor) — 35 § 780-113 §§ A16
  • Conspiracy  (a felony) — 18 § 903 §§ C

Our client pleaded guilty to the felony charge of Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver (often called “PWID”, or “Possession with Intent to Distribute”).

During the sentencing phase of the case, criminal defense attorney Tom Kenny, drawing on his skills as a former Philadelphia Assistant District Attorney, pointed out inconsistencies in the police’s records of evidence seized during the arrest. Mr. Kenny successfully argued that our client should be allowed to remain on house arrest instead of being sent to prison.

As a result, our client is now able to remain at home with his family. He is even allowed to leave the house to attend his job, where he can make an honest living and continue providing for his family.
