Civil rights lawyer Eileen Burns recently filed a lawsuit against the City of Philadelphia on behalf of an inmate who was the victim of a vicious attack in a Philadelphia prison.
Part of the claims against the City are called Monell claims, in which attorney Burns alleged that the City had allowed a practice or procedure to continue in place, which contributed to the prisoner’s assault. The City filed a motion to dismiss the Monell claim. The Federal Court ultimately denied the motion, saying that the Plaintiff–that is, our client–had enough evidence to proceed.
