As jails and prisons throughout Pennsylvania and the United States are working to reduce their populations in light of the coronavirus pandemic, inmates who are only being held on a detainer may be eligible for release if an experienced criminal defense attorney files a detainer motion on their behalf.
It is very important to file and argue this type of motion quickly and forcefully to obtain justice. We have been filing detainer motions as emergency motions so that they are put in front of a judge as soon as possible, even while most courts are currently closed for most legal business.
The attorneys at Kenny, Burns & McGill are no strangers to this type of legal procedure. They have filed hundreds of detainer motions in Bucks County, Philadelphia, Montgomery County, Chester County, Delaware County, and throughout Pennsylvania and New Jersey.
Our attorneys recently filed and won an Emergency Detainer Motion in Philadelphia. Today, we got some good news about another similar motion in Bucks County: after Attorney Thomas Kenny filed the written motion, the prosecutor on our client’s case reached out to our office and agreed not to oppose the motion.
The only step left is for the judge to sign an order releasing our client, who is being held at Bucks County Correctional Facility.
Since prisons are often crowded and medical treatment and testing can be difficult to obtain, they can be a breeding grounds for harmful diseases, including COVID-19, the disease caused by the novel coronavirus.
Prosecutors are fully aware of this problem and have been willing to work with our attorneys to ensure a positive outcome. If they are not willing to work with us, we are not afraid to argue the motion in front of a judge.
Obviously, our client’s family is excited beyond words, knowing that their loved one will be returning home soon.
If you or someone you know needs a criminal defense attorney, contact us immediately. We are available 24/7, even during the coronavirus pandemic. We will never stop advocating for our clients, especially in times when their health is at stake.
