Today, a real estate client of Kenny, Burns & McGill received the very good news that a default judgment which had been entered against his enterprise was vacated (or overturned) in the Philadelphia Court of Common Pleas.
Our client explained to us that a former worker had filed the personal injury case against him and previously entered a default judgment against him. The Plaintiff, our client’s ex-employee, essentially won their case without ever taking our client to court.
After careful case review, attorney Thomas Kenny discovered that the Plaintiff never properly served our client. After filing a motion to have the judgment removed, the court came to see the situation the same way as Mr. Kenny, and vacated the judgment.
