Another client of Kenny, Burns & McGill can return home today after attorney Thomas Kenny managed to have felony drug trafficking charges dropped. On or around August 14, 2017, our client was arrested for the following charges:
35 Pa.C.S. § 780-113 §§ A30 Manufacture, Delivery, or Possession of a Controlled Substance with the Intent to Deliver (an ungraded felony);
18 Pa.C.S. § 903 Conspiracy to Manufacture, Deliver, or Possess a Controlled Substance with the Intent to Deliver (an ungraded felony); and
35 Pa.C.S. § 780-113 §§ A16 Intentional possession of a controlled substance (an ungraded misdemeanor).
The charges stemmed from an incident which allegedly occurred on July 26, 2017, when the authorities at JFK International Airport in New York City confiscated a package which had arrived from the Dominican Republic and contained over half a kilo of heroin. The drug package was eventually set up as a controlled delivery in Allentown, and two people were arrested as a result.
Police agents determined that the address in Allentown was fictional and managed to make contact with other people they believed were involved in trafficking the narcotics. The underlying fictional address was changed to a real address in the Allentown area of Lehigh County, and the police set up a sting operation to arrest the people they believed were responsible.
After applying for search warrants and phone taps, an in-depth investigation ensued. Under the cloak of warrants, agents listened to various phone conversations to determine the nature and extent of the drug dealings, which eventually led to even more arrests. Lead trial attorney Thomas Kenny, of Kenny, Burns & McGill, entered into the fray after which it had been determined that various irregularities had occurred with the chain of evidence involving the drugs and the phone taps in the case.
Mr. Kenny’s client, who had no previous arrests, spent over 11 months in jail on $100,000 cash bail. Mr. Kenny successfully got all felony charges dismissed and our client was able to go home and rejoin her family.
