In January 2019, police were called following reports of gunfire coming from a sleepy street in West Philadelphia. Found at the scene were three unregistered guns, nearly a kilogram of marijuana and cocaine, and fired cartridge casings (FCC’s). Police made multiple arrests, including one person who ultimately hired attorney Thomas Kenny, of Kenny, Burns & McGill, to defend his rights throughout the criminal justice process.
Our client was initially charged with the following offenses, all of which are very serious:
- Manufacture, Delivery, or Possession of a Controlled Substance with Intent to Manufacture or Deliver (F) 35 Pa.C.S.A § 780-113 §§ A30;
- Conspiracy (F) 18 Pa.C.S.A. § 903 §§ C; Discharge of a Firearm into Occupied Structure (F3) 18 2707.1 §§ A;
- Knowing and Intentional Possession of a Controlled Substance by a Person Not Registered (M) 35 Pa.C.S.A. § 780-113 §§ A16;
- Possession of Marijuana (M) 35 Pa.C.S.A. 780-113 §§ A31; Use/Possession of Drug Paraphernalia (M) 35 Pa.C.S.A. 780-113 §§ A32;
- Possession Instrument of an Instrument of a Crime with the Intent to Employ it Criminally (M1) 18 Pa.C.S.A. § 907 §§ A; and
- Recklessly Endangering another Person (M2) 18 § 2705.
Following a hearing at the Juanita Kidd Stout Center for Criminal Justice, Attorney Kenny was able to successfully argue for all of the charges against our client to be dismissed.
