Two released from prison

Two released from prison. Two recent clients found trouble with Delaware County Probation Department and found themselves jailed in George Hill Correctional Facility for probation violations. There are two kinds of probation violations, that is, direct and technical. A direct violation is when one is convicted of a new criminal offense when on probation for another matter. A technical violation can occur from a new arrest, a positive drug test, or missing appointments with the probation officer.

These two clients both had technical violations for missing meetings with their PO and failed drug tests. Both were detained by the probation department and jailed. Both clients hired Thomas D. Kenny, Delaware County Criminal Lawyer, of Kenny, Burns & McGill to help assist them.

Attorney Kenny went right to work and filed his entry of appearance followed by motions to lift detainers. An entry of appearance is filed to notify the court that an attorney is now working on a client’s case. A motion to lift a detainer is filed to request the court to lift the probation detainer and allow the client to go home. Two released from prison.

Under the law, there is a preliminary hearing for a probation violation, which is known as a Gagnon 1. The final hearing for a probation violation is is known as a Gagnon 2.

Delaware County Criminal Lawyer Kenny appeared on December 4, 2020 and December 7, 2020 respectively for the two clients and was able to obtain their release. Two released from prison.
